Proposed Bylaws Article 7.1 (i) Information

Symphony Village Residents:

As you may be aware, homeowners continue to express concern regarding Article 7.1 (i) in the redlined draft (lines 250 – 260) of the proposed Bylaw changes, specifically relating to the use of the term ‘attorney-in-fact’. 

Please be assured the proposed language in Article 7.1 (i) does not infer the Board intends to act as attorney-in-fact on behalf of an individual owner, their lot or their personal affairs. The proposed language is common in community association documents and was recommended by counsel in its entirety.

The language was recommended to solidify the responsibilities of the Board as it relates to the common area only and ensure all powers, functions and duties of the Board as described in the Governing Documents and the Maryland Homeowners Association Act can be properly fulfilled in certain circumstances.
